What is a McKenzie Friend?
The concept of the McKenzie Friend originates from case McKenzie v McKenzie (1970), where the Court of Appeal confirmed that a civil litigant could receive reasonable assistance in court from a person of their choosing.
The Practice Guidance: McKenzie Friends (Civil and Family Courts), issued by the Master of the Rolls and the President of the Family Division, Sir Andrew McFarlane, defines the role and scope of McKenzie Friends. They may provide moral support, take notes, assist with document management, and give quiet advice. While McKenzie Friends in England and Wales can charge a fee, they do not have rights of audience and cannot conduct litigation. A judge may refuse or limit a McKenzie Friend’s participation if they fail to comply with procedural rules or if their involvement would disrupt the court process.
